These Terms are a legal agreement between you and Echelon Edge Pty Ltd. By creating an account or using Talk Trail, you agree to be bound by them. Questions? Contact support@talktrail.co before using the service.
1. Parties and Eligibility
These Terms govern your use of Talk Trail — the web application, iOS and Android apps, and all related features (Service) — operated by Echelon Edge Pty Ltd (ABN 12 102 962 532), Queensland, Australia (Echelon Edge, we, us). Read these Terms with our Privacy Policy at talktrail.co/privacy, incorporated here by reference. Where local law gives you greater rights, those rights apply.
To use Talk Trail you must be at least 16, have capacity to contract in your jurisdiction, not be legally prohibited from using the Service, and provide accurate account information. Talk Trail is not intended for under-16s; we will delete any such account promptly. Each account is for one individual — creating multiple accounts to circumvent limits may result in all accounts being terminated.
You are responsible for your account credentials and all activity under your account. Notify us immediately at support@talktrail.co of any unauthorised access. We are not liable for loss arising from your failure to maintain account security.
2. The Service
Talk Trail analyses signals from your email and calendar activity to compute anonymised stress indicators and activity categories, delivering personalised wellbeing nudges. The Service is under active development — features may change with reasonable notice. We aim for reliability but do not guarantee uninterrupted availability; the Service may be interrupted for maintenance or infrastructure reasons outside our control.
Important: Talk Trail is a general wellbeing tool. It is not a medical device, a mental health service, or a substitute for professional medical, psychological, or psychiatric care. Nothing in the Service constitutes medical advice, diagnosis, or treatment. If you have concerns about your mental or physical health, consult a qualified healthcare professional.
3. Free Trial and Subscriptions
New accounts receive a 14-day free trial with full Premium access. No payment is required to start. If you do not subscribe at trial end, Premium features are suspended. We will remind you before the trial expires and you may cancel during the trial at no charge.

All prices in USD, inclusive of applicable taxes where collected at checkout. We may change pricing with at least 30 days' notice; continued use after the effective date constitutes acceptance.
Subscriptions auto-renew each period unless cancelled before the renewal date. Cancellation takes effect at end of the current period — access continues until then. Cancelling does not delete your account (see clause 10 to delete). Fees are non-refundable once a period commences except as required by law. Billing errors: contact support@talktrail.co within 30 days.
Australian Consumer Law: Your ACL consumer guarantee rights cannot be excluded. Where the ACL applies and the Service fails to meet a consumer guarantee, our liability is limited (at our election) to re-supplying the service or paying the cost of re-supply. Nothing in these Terms limits rights that cannot be excluded under the ACL.
Payments processed by Stripe Inc (stripe.com/au/legal). Echelon Edge never sees, stores, or processes your card number, expiry, or CVV.
4. Email and Calendar Integration
Connecting a Gmail, Google Calendar, Outlook, or Exchange account is optional. We use OAuth 2.0 (no password required) and request only the minimum permissions needed. By connecting, you authorise Talk Trail to read metadata (subject lines, sender names, event titles, timestamps, durations) within your configured look-ahead window, confirm you have the right to grant that access, and acknowledge this is governed by these Terms and the Privacy Policy.
We do not request permission to send emails, modify your calendar, or access your contacts. Connecting does not alter your relationship with Google or Microsoft — your use of those accounts remains subject to their own terms and policies. We are not responsible for changes they make to API access that affect Talk Trail's connectivity. Disconnect at any time via Settings > Connections or directly through your Google or Microsoft account security settings.
5. Privacy Modes
Strict (default): Metadata processed transiently on secure servers to compute an anonymised signal. Raw content immediately discarded and never stored. The AI receives only the anonymised signal.
Enhanced (opt-in): In addition to Strict processing, a de-identified summary (initials and roles only, no quoted content) is used during AI processing for more specific nudges. Same no-raw-storage rule applies. Switch back to Strict at any time from Settings > Privacy; changes take effect immediately.

6. Acceptable Use
Talk Trail is licensed for your personal, non-commercial use. You must not, and must not attempt to:
- use Talk Trail unlawfully or in violation of applicable regulations
- resell, sublicence, or commercially exploit the Service without our written consent
- use bots, scrapers, or automated tools to access or extract data from the Service
- reverse engineer, decompile, or attempt to derive Talk Trail's source code
- circumvent or interfere with any security, authentication, or access control feature
- introduce malware, viruses, or malicious code into the Service
- harvest personal information about other users
- impersonate any person or misrepresent your affiliation with any entity
- access any account or data that is not yours
Breach of this clause may result in immediate account suspension or termination without refund, and may expose you to civil or criminal liability.
7. Intellectual Property
Echelon Edge owns or licences all IP in the Service (including the Talk Trail name, logo, software, and algorithms). These Terms do not transfer any IP rights to you. Subject to these Terms and payment of fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal use during your subscription.
You retain ownership of your email and calendar content. By connecting your accounts, you grant us a limited licence to process that content solely as described in these Terms and the Privacy Policy. Anonymised derived signals (stress indicators and activity categories) cannot be reverse-engineered to reveal your personal data; we may use aggregated, de-identified analytics to improve the Service. Feedback you provide may be used by us for any purpose without obligation.
8. Third-Party Services
Lovable (Lovable Labs Inc): Application infrastructure, database, and hosting under a Business plan DPA. lovable.dev/legal.
Stripe Inc: Payment processing. stripe.com/au/legal.
Google LLC: Gmail / Google Calendar integration (if connected). policies.google.com.
Microsoft Corporation: Outlook / Exchange integration (if connected). privacy.microsoft.com.
Echelon Edge is not responsible for the practices or availability of any third-party service.
9. Disclaimers and Limitation of Liability
Disclaimer: To the maximum extent permitted by law, Talk Trail is provided "as is" and "as available" without warranty of any kind. We do not warrant the Service will be uninterrupted, error-free, or meet your specific requirements. Nudges and recommendations are informational only and do not constitute professional advice. Do not act or refrain from acting solely on the basis of Talk Trail outputs.
Liability cap: To the maximum extent permitted by law, Echelon Edge's total liability for all claims under or in connection with these Terms is limited to the greater of: (a) total subscription fees paid in the 12 months preceding the claim; or (b) AUD 100. We are not liable for any indirect, consequential, special, or punitive loss; loss of profits, revenue, data, or goodwill; damage to email or calendar account data; reliance on Service outputs; failure to maintain account security; or events outside our reasonable control. These limits apply even if we have been advised of the possibility of such loss. Nothing excludes liability for death or personal injury from negligence, fraud, or fraudulent misrepresentation.
Jurisdictional note: EU/UK and some US consumers may have additional rights that limit the above exclusions. The ACL consumer guarantee rights noted in clause 3 also apply here. Local mandatory consumer protection provisions prevail where they conflict with these Terms.
10. Indemnification and Termination
You agree to indemnify Echelon Edge and its officers, employees, and agents against claims, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, violation of applicable law, infringement of third-party rights, or data you provide through the Service. This indemnity does not apply to the extent a claim arises from our own negligence or wilful misconduct.
You may terminate your account at any time via Settings > Account > Delete Account or by emailing support@talktrail.co. No refund is issued for the current billing period; your data is deleted within 30 days. Echelon Edge may suspend or terminate your account immediately, without refund, for material breach, fraudulent or unlawful conduct, or legal requirement. If we discontinue Talk Trail entirely, we will give at least 60 days' notice and pro-rata refund any prepaid fees. On termination, your licence ends immediately; clauses 7, 9, and 12 survive.
11. Changes to These Terms
We may update these Terms and will post revisions at talktrail.co/terms. For material changes (including to pricing, liability, or dispute resolution), we will give at least 30 days' notice by email or in-app notification. Continued use after the effective date constitutes acceptance. If you do not accept revised Terms, cancel before the effective date.
12. Governing Law and Disputes
These Terms are governed by Queensland, Australia law. The courts of Queensland have non-exclusive jurisdiction. EU and UK subscribers may also bring proceedings in their country of residence; mandatory local consumer protection provisions apply. Before commencing formal proceedings, contact support@talktrail.co and attempt to resolve the dispute in good faith for 30 days (this does not affect your right to seek urgent injunctive relief). To the extent permitted by law, disputes must be resolved individually and not as part of a class action.
The class action waiver may be unenforceable in certain jurisdictions including under EU consumer law. You may always lodge a complaint with a relevant regulator: ACCC (Australia), national consumer authority (EU), or FTC (US).
13. General
Entire agreement: These Terms and the Privacy Policy are the entire agreement between the parties for the Service.
Severability: If any provision is invalid or unenforceable, it is severed; remaining provisions continue in effect.
No waiver: Failure to enforce any right is not a waiver of that right.
Assignment: You may not assign these Terms without our written consent. We may assign to an affiliate or on a sale of our business, with notice.
Force majeure: We are not liable for failure caused by events outside our reasonable control.
Notices: Notices to you go to your account email. Notices to us go to support@talktrail.co.
Language: English governs; translations are for convenience only.
